Vietnam has a modern intellectual property framework anchored by the Law on Intellectual Property, updated in recent amendments, and shaped by its WTO and free-trade-agreement commitments. This overview orients foreign businesses to what is protectable and how.
Rights available
- Industrial property — trademarks, patents and utility solutions, industrial designs, geographical indications, layout designs and trade secrets.

First-to-file and registration
For most industrial property rights, Vietnam applies first-to-file — priority goes to the earliest applicant. Registration is handled mainly by the Intellectual Property Office of Vietnam; copyright registration (optional but useful as evidence) is handled by the Copyright Office. Foreign applicants without a local presence must act through a licensed IP agent.
Enforcement
Rights can be enforced through administrative measures (the fast, common route), customs recordal, civil litigation for damages, and criminal prosecution for commercial-scale counterfeiting. A layered strategy usually delivers the best commercial result.
