What Is a Trademark? Why Register One?

Under Article 4(16) of the 2005 Law on Intellectual Property as amended in 2022, a trademark is a sign used to distinguish the goods or services of different organizations or individuals. A trademark may consist of words, letters, images, colors, or a combination of these elements.

Trademark vs. Brand

A trademark is a tangible sign that is legally registered with the Intellectual Property Office, creating an enforceable exclusive right. A brand is a broader concept — encompassing customers' perception of a business — and cannot be registered. You register a trademark in order to protect your brand.

Types of Protectable Trademarks

Ordinary Trademark

A sign (words, logo, image, color, or combination) used to distinguish the goods/services of a single individual or organization

Collective Trademark

Registered by a collective organization (cooperative, association, etc.) for joint use by its members for their goods/services

Certification Trademark

Used for goods/services that meet certain quality or origin standards. The owner does not use it directly

Well-Known Trademark

Protected without registration due to widespread recognition. Recognized under Article 75 of the Law on Intellectual Property

Legal requirements

Trademark Protection Requirements

Not every sign qualifies for registration as a trademark. Under Articles 72-73 of the Law on Intellectual Property, a trademark must satisfy the distinctiveness requirement and must not fall within any of the prohibited categories.

Can be registered

  • Words, letters, or numerals capable of distinguishing
  • Distinctive logos, images, or symbols
  • Color combinations with clear identifying features
  • Combined marks (words + image + color)
  • Distinctive slogans
  • Sound marks (represented graphically)
  • Distinctive packaging or product designs
  • Business names combined with a distinctive element

Cannot be registered

  • National flags, emblems, and anthems of Vietnam and other countries
  • Names or symbols of state agencies or political organizations
  • Names or images of national leaders or heroes
  • Signs that are misleading as to the origin or quality of goods
  • Words that precisely describe the characteristics of goods (e.g., "DELICIOUS" for food products)
  • A single color with no distinctive element
  • Marks identical or confusingly similar to previously registered trademarks
  • Signs that violate social morals or public order

Note on the "First-to-File" principle

Vietnam applies the "First-to-File" principle (whoever files first is protected first). If a competitor registers your mark before you do — even if you are already using it — they can require you to stop using it. Therefore, register as early as possible.

Implementation process

Trademark Registration Process in Vietnam

7 steps under Decree 65/2023/ND-CP and Circular 23/2023/TT-BKHCN. The statutory timeline is 12-18 months, though actual processing often extends to 18-24 months depending on the IP Office's backlog.

Trademark Search
Search the Intellectual Property Office's database to check for identical or confusingly similar marks already registered. This is a critical step — about 80% of rejected applications skipped it. Includes a free preliminary online search plus an in-depth search by an IP specialist, together with an assessment of the likelihood of successful registration.

Drafting the Application
Prepare the complete dossier in accordance with Decree 65/2023/ND-CP, including the declaration form (Form No. 08), the trademark specimen, the list of goods/services classified under the Nice Classification, and related documents.

Filing with the Intellectual Property Office
File the application with the Intellectual Property Office of Vietnam (in Hanoi, Ho Chi Minh City, or Da Nang) or through the online public-service portal. Receive an application number and filing date — this date establishes priority rights.

Formality Examination
The IP Office checks the completeness and validity of the application. If the application passes, a notice of acceptance is issued; if not, a 2-month period is granted for amendment or supplementation.

Publication of the Application
The application is published in the Industrial Property Gazette. Third parties have 5 working days to oppose the application (under the latest regulations). Substantive examination then begins.

Substantive Examination
The longest step. The IP Office assesses registrability — distinctiveness, absence of conflict with prior marks, and compliance with legal requirements. The applicant may receive a provisional refusal notice and must respond with supporting arguments.

In practice, actual processing often extends to 18-24 months depending on the IP Office's application backlog.

Grant of the Certificate
After a decision to grant protection is issued, pay the grant fee (second installment) to receive the original Certificate of Trademark Registration. Protection lasts 10 years from the filing date and is renewable indefinitely.

  • Trademark registration declaration (Form No. 08 under Decree 65/2023)
  • Trademark specimen: 5 copies, 80×80 mm
  • List of goods/services classified under the Nice Classification
  • Copy of ID card or passport
  • Power of attorney (if filed through an IP representative)
  • Proof of payment of official fees
For Enterprises
  • Trademark registration declaration (Form No. 08 under Decree 65/2023)
  • Trademark specimen: 5 copies, 80×80 mm
  • List of goods/services classified under the Nice Classification
  • Copy of the Enterprise/Business Registration Certificate
  • Power of attorney signed and sealed by the enterprise
  • Proof of payment of official fees
  • Documents evidencing the right of use (if the mark contains special elements)

Note on the trademark specimen: It must be printed in color (the exact color to be protected), sized 80×80 mm, in 5 copies. Use a white background; do not staple or fold the specimen. If the mark is black-and-white, reproduce it precisely in black-and-white.

Under Circular 263/2016/TT-BTC (original fee schedule) and Circular 64/2025/TT-BTC (50% fee reduction until 31/12/2026). Applicable to 1 class with ≤6 products/services.

Fees currently in effect until 31/12/2026 (50% reduction under Circular 64/2025/TT-BTC): the filing fee is reduced to VND 75,000, and the grant fee to VND 60,000 for the first class / VND 50,000 for additional classes. The total amount actually payable is approximately VND 1,225,000.

VNeID incentive (01/04/2026-31/12/2026): Applications filed through the VNeID platform are fully exempt from the filing fee and the grant fee, saving an additional VND 135,000.
