Overview

What is an invention? Why does it need protection?

Under Article 4(12) of the 2005 Law on Intellectual Property as amended in 2022, an invention is a technical solution in the form of a product or process intended to solve a specific problem by applying natural laws. An invention is protected by way of a Patent of Invention (20 years) or a Utility Solution Patent (10 years).

Legal requirements

Protection requirements and unprotectable subject matter

Not every technical solution qualifies for patent protection. Under Article 59 of the Law on Intellectual Property, the following subject matter is not protected as an invention:

Can be patented

  • Technical products (equipment, machinery, chemical compounds)
  • Industrial production processes/methods
  • New materials or preparations with technical features
  • Microorganisms and microbial processing processes (except purely biological ones)
  • Combined software-hardware solutions with a technical effect
  • Equipment improvement solutions (registered as a utility solution)

Cannot be patented

  • Scientific discoveries, theories, and mathematical methods
  • Methods for preventing, diagnosing, or treating disease in humans/animals
  • Plant or animal production processes of a purely biological nature
  • Pure computer programs (protected under copyright)
  • Schemes for economic organization and management
  • Products that are merely a matter of form (protected as industrial designs)

Important: file before disclosing

Vietnam applies an absolute worldwide novelty standard. If an invention has been disclosed anywhere in the world before the filing date, its novelty is lost. Implementation process

Patent registration process in Vietnam — 8 steps

Under Articles 58-66 of the 2005 Law on Intellectual Property as amended in 2022 and Decree 65/2023/ND-CP. Overall timeline: 36-48 months.

Assess novelty and patentability
Conduct a prior art search / state of the art search to determine the invention's worldwide novelty; assess inventive step against published technical documents. This step determines whether an application should be filed at all.

Choose the type of protection title
Advise on choosing between a Patent of Invention (20 years, requires a high inventive step) or a Utility Solution Patent (10 years, lower requirement, higher chance of grant) based on the technical nature of the solution.

Draft the specification and claims
Draft the patent specification (description of invention), independent and dependent claims, the abstract, and illustrative technical drawings.

This is the most important step — the quality of the claims determines the actual scope and value of the protection.

File the application with the IP Office
File the application with the Intellectual Property Office of Vietnam (in person, by post, or through the online filing system). Receive the filing date — this becomes the invention's priority date.

Formality examination
The IP Office checks the completeness and formal validity of the application. If information is missing or there are formal errors, the Office issues a notice requesting amendment or supplementation within a set deadline.

Mandatory publication of the application
The patent application is published in the Industrial Property Gazette in the 19th month from the filing date (or priority date, if any). The applicant may request earlier publication to protect its interests.

Substantive examination
The IP Office examines the protection requirements: novelty, inventive step, and industrial applicability. LTV Law's specialists monitor the process, respond to examination opinions, and argue in defense of the claims.

Grant of the protection title
The IP Office issues a Decision granting the Patent of Invention (or Utility Solution Patent). The applicant pays the grant fee and receives the original title. Validity is maintained by paying annual fees on schedule.

The specification — the most important document

The specification and claims are the most complex technical-legal documents in a patent dossier. The actual scope of protection depends entirely on how the claims are drafted: too narrow and they are easily worked around; too broad and the application is rejected for lack of novelty. Maintenance fees increase progressively over each period: from VND 300,000/year (years 1-3) up to several million VND/year (years 17-20). The estimated total official maintenance fee for a full 20-year protection term is around VND 15-20 million. Late payment can be made within a 6-month grace period; after that the title is terminated.

50% fee reduction: Filing, examination and grant fees are currently reduced 50% under Circular 64/2025/TT-BTC, applicable until 31/12/2026.
