The Madrid system — what is international trademark registration?

The Madrid System is an international trademark registration mechanism administered by the World Intellectual Property Organization (WIPO), allowing a trademark owner to protect their brand in multiple member countries through a single application, one language (English, French, or Spanish), and a single fee payment at the office of origin.

Vietnam joined the Madrid Protocol in 2006. Vietnamese businesses and individuals may file an international trademark application at the Intellectual Property Office of Vietnam (NOIP) — address: 386 Nguyen Trai, Thanh Xuan, Ha Noi — to extend protection to 130+ markets.

Madrid Protocol 1989; Paris Convention 1967; the Law on Intellectual Property 2005, amended 2022 (Article 94 and Chapter IX); Decree 103/2006/ND-CP; Circular 01/2022/TT-BKHCN.

Term of protection and renewal

An international registration is valid for 10 years from the date WIPO issues the registration number. It can be renewed every 10 years, an unlimited number of times, using form MM11/MM18 at WIPO. Note the risk of a Central Attack: within the first 5 years, if the basic mark in Vietnam is cancelled, the international registration is also terminated.

Conditions

Conditions for registering a trademark internationally

To file an international trademark application under the Madrid system through NOIP Vietnam, the applicant must simultaneously satisfy the following conditions:

1. Have a basic mark in Vietnam (Basic Mark)

Must have, or have pending, a trademark application at the Intellectual Property Office of Vietnam — either an already-granted registration certificate or an application number pending examination.

2. Scope of goods/services must not exceed the basic mark

The list of goods/services in the MM2 international application may not be broader than the list already registered under the basic mark in Vietnam.

3. The applicant is a Vietnamese citizen/legal entity

Or has a real and effective industrial or commercial establishment in Vietnam, as required under the Madrid Protocol.

Important note on Central Attack

Within the first 5 years from the date of international registration, if the basic mark in Vietnam is cancelled, withdrawn, or invalidated — the entire international registration in every country will also be terminated. After the 5th year, the international registration becomes fully independent. This is a risk that must be actively managed.

Process

Clearance search and registrability assessment
Search trademark databases in each target country and assess conflicts with previously registered marks. The search results form the basis for advising on the optimal filing strategy.

Identify the basic mark
Confirm the Vietnamese trademark registration certificate or the basic application number, and review the list of goods/services to be protected to ensure it does not exceed the scope of the basic mark.

Prepare the MM2 application
Draft the MM2 international application in accordance with WIPO requirements: translate the list of goods/services into English or French under the Nice Classification, determine the list of designated countries, and calculate the WIPO fees.

File through the Intellectual Property Office
File the application with the Intellectual Property Office of Vietnam (NOIP) — the office of origin under the Madrid Protocol. NOIP checks the formalities, certifies the filing date, and forwards the complete file to WIPO in Geneva.

WIPO issuance and publication
WIPO conducts a final formalities check, issues the International Registration Number, and publishes the mark on Madrid Monitor/ROMARIN. Official notification is then sent to each designated country.

Examination in each designated country
The IP office of each country examines the mark within 18 months (some countries, such as the EU, may extend this by a further 6 months). If a provisional refusal is issued, LTV Law drafts the response and represents the applicant in the appeal.

Receiving the Statement of Grant of Protection
Each country issues its own Statement of Grant of Protection. The mark is protected independently in each country. Total time from the filing date: 18-30 months.

Notes on the trademark image:

  • JPG or PNG format, plain white background, minimum resolution of 300 dpi
  • If filing a color mark: the WIPO basic fee increases from CHF 653 to CHF 903
  • If filing in black-and-white: protection is not tied to color (broader scope)

Important note on individual fees: Countries such as the US (USPTO), the EU (EUIPO), Japan (JPO), Australia (IP Australia), and Canada do not apply a complementary fee but instead charge their own individual fee — which can be considerably higher than the usual CHF 100/country complementary fee. The total WIPO fees for a typical 3-country Madrid application (China, EU, US) with 2 classes for a black-and-white mark can run from CHF 3,000-5,000 or more.
