What Is Copyright? Automatic or Requires Registration?

Under Article 6 of the 2005 Law on Intellectual Property (as amended in 2022), copyright arises automatically as soon as a work is created — no registration, notification, or fee is required. This is a core principle of the Berne Convention, which Vietnam joined in 2004.

So why register at all?

Registering at the Copyright Office of Vietnam provides tangible benefits:

  • The Certificate is legally valid evidence before a court
  • It is the basis for requesting state authorities to handle infringement
  • It is the basis for filing a lawsuit for damages
  • It proves the date the author created the work (priority evidence)

Copyright Registration Process in Vietnam

6 steps under Article 52 of the Law on IP and Circular 08/2023/TT-BVHTTDL. Total time: 15–20 working days.

Consultation to identify the type of work
Precisely identify the type of work (literary, musical, software, fine art, etc.) and the authorship rights to be registered (moral rights plus economic rights, or economic rights only).

Preparing the work for registration
Prepare 2 copies of the work to be registered (printed copy or digital file); determine the author's name, the year of creation, and the date of first publication (if any).

Drafting the registration application
Complete the registration application on the official form; draft supporting explanatory documents (if needed); prepare the power of attorney and the applicant's legal documents.

Filing the application at the Copyright Office of Vietnam
File directly at the Copyright Office of Vietnam (33 Ngo 294/2 Kim Ma Street, Ba Dinh, Hanoi) or at the Southern regional representative office; or file by post.

Examination of the application
The Copyright Office of Vietnam checks the validity and completeness of the application and notifies the applicant if further documents are required. LTV Law monitors the process and responds promptly.

Receiving the Certificate of Copyright Registration
Receive the Certificate of Registration of Authorship/Related Rights. Keep the original safely — it is legal evidence of ownership of the work.

Documents Required for Copyright Registration

  • Application for registration of authorship/related rights (on the form issued by the Copyright Office of Vietnam)
  • 2 copies of the work: printed copy (literary/music/image works) or digital file on CD/USB (software)
  • Author's ID card/Citizen ID/Passport (notarized copy)
  • Business Registration Certificate (if registering under a company name)
  • Power of attorney for LTV Law (if represented)
  • Documents proving the right to file (creation contract, work assignment decision — if owned by an organization)

Note on the accompanying copy of the work: For software, only a representative excerpt of the source code (the first and last 50–100 pages) needs to be submitted — the full source code is not required. The Copyright Office of Vietnam is committed to keeping the source code confidential. For fine art/photographic works, submit a clear color print of at least A4 size.

Under Circular 211/2016/TT-BTC. Government fees are very low — the main cost is the service of drafting and filing the application.
