Trademark Searches in Vietnam: Why and How to Clear Your Mark
A pre-filing trademark search reduces the risk of refusal and conflict. How searching works in Vietnam, what it covers, and its limits for foreign applicants.

Because Vietnam is a first-to-file jurisdiction, a pre-filing search is one of the most cost-effective steps a foreign applicant can take. It reveals earlier marks that could block registration before you spend on filing.
Why search first
A search shows whether identical or confusingly similar marks already exist for related goods/services. Finding a conflict early lets you adjust the mark, narrow the specification, or plan a coexistence or opposition strategy — instead of losing filing fees and time on an application that will be refused.
What a search covers
A professional clearance search reviews the national trademark register (pending and registered marks), including marks designating Vietnam through the Madrid System, across the relevant Nice classes. It assesses both identical marks and similarity in appearance, sound and meaning.
Limits to keep in mind
No search is a guarantee. Very recently filed applications may not yet appear, and examiners retain discretion on similarity and distinctiveness. A search materially lowers risk but does not eliminate it, so results should be read together with legal advice.
