Trademark infringement in Vietnam is most often handled through administrative measures, which impose fines and remedial actions quickly and at lower cost than litigation.
Administrative penalties
Under the administrative-sanctions framework (Decree 99/2013 and related rules), infringers can face fines, seizure and destruction of infringing goods, removal of infringing elements, and suspension of the infringing business activity. The fine scales with the value of the infringing goods.
Beyond fines
For damages, the rights holder must pursue civil litigation; administrative action alone does not compensate the owner. Commercial-scale counterfeiting can additionally attract criminal liability, including penalties for the responsible individuals and the company.
Triggering enforcement
Enforcement usually starts with evidence — test purchases, notarised records and, where needed, an expert assessment confirming infringement — followed by a request to the competent authority. A valid registration certificate underpins any action.
