Vietnamese law protects a broad range of literary, artistic and scientific works by copyright. Protection arises automatically once a work is created and expressed in a tangible form, and the same categories of works may be recorded through voluntary registration with the Copyright Office of Vietnam.

Main categories of protected works

The Law on Intellectual Property recognises many types of works, including:

  • Literary and written works, such as books, articles and computer programs;
  • Musical works, with or without lyrics;
  • Dramatic and stage works, and related scripts;
  • Cinematographic and audiovisual works;
  • Works of fine art and applied art, including paintings, sculptures and designs;
  • Photographic works and architectural works;
  • Maps, drawings, sketches and other scientific works.

Copyright protects the original expression of a work, not the idea, process, method or data behind it. Certain materials are excluded from protection, such as news of the day that is purely informational, official legal and administrative texts and their official translations. Separately, inventions and industrial designs are protected as industrial property rather than by copyright, and are handled by the Intellectual Property Office of Vietnam.

Why the category matters for registration

When applying to register, the correct classification of a work affects the sample copies and supporting documents required. For example, a software program is treated as a literary work, while a logo may be filed as a work of applied art. Identifying the category accurately helps avoid delays and ensures the certificate reflects the true nature of the work.
