Copyright Registration for Songs and Musical Works in Vietnam
How composers, lyricists and producers can protect songs and musical works in Vietnam, and why voluntary copyright registration is useful evidence of ownership.

Under Vietnamese law, copyright in a musical work arises automatically the moment the work is created and fixed in a tangible form, without any requirement to register. For songwriters, composers and producers, however, obtaining a certificate of copyright registration provides a clear, dated record of authorship that is valuable if ownership is ever disputed.
What is protected in a musical work
A song typically combines several protectable elements: the melody and musical composition, the lyrics as a literary work, and any recorded performance. Copyright protects the original expression rather than the underlying idea or musical style. Where several people contribute, the rights may be held jointly, so it is sensible to agree in writing on the shares of composer, lyricist and arranger before release.
Registering with the Copyright Office
Registration is handled by the Copyright Office of Vietnam. A typical application includes:
- An application form identifying the author and the copyright owner;
- Copies of the work, such as sheet music, lyrics and a recording;
- Documents showing how rights were acquired, for example an employment or commission agreement;
- Authorisation if the filing is made through a representative.
On approval, the office issues a registration certificate recording the author and owner. This certificate shifts the practical burden of proof in later disputes, as the registered owner is presumed to hold the rights unless the contrary is shown.
Related rights of performers and producers
Beyond the author's copyright, performers, phonogram producers and broadcasters hold separate related rights in their performances and recordings. A single commercial track may therefore involve both copyright in the underlying work and related rights in the sound recording, which are often owned by different parties and licensed independently.

Do I have to register to own copyright in my song?
No. Copyright exists automatically on creation. Registration is optional but provides strong documentary evidence of ownership.
Can foreign musicians register works in Vietnam?
Foreign authors may seek protection in Vietnam, generally through the framework of international treaties to which Vietnam is a party. Local counsel can advise on the appropriate route.
Does registration cover both the music and the lyrics?
The composition and the lyrics can be protected, though they may be treated as distinct works. It is common to identify each element clearly in the application.
