The Trademark Registration Process and Timeline in Vietnam
Step by step: formality examination, publication, substantive examination and grant — plus realistic timelines for registering a trademark in Vietnam.
Table of contents
Registering a trademark in Vietnam follows a defined sequence at the Intellectual Property Office of Vietnam (IP Vietnam). Knowing each stage helps foreign applicants plan filings and budget realistically.
The four stages
- Formality examination (~1 month) — the office checks the application meets formal requirements (applicant details, representation, goods/services, classification).
- Publication (~2 months) — a formally accepted application is published in the Industrial Property Official Gazette, opening a window for third-party opposition.
- Substantive examination (up to 9 months by law) — the office assesses distinctiveness and conflicts with earlier marks.
- Grant — if accepted and fees are paid, a Trademark Registration Certificate issues.
Realistic timeline
By law the process is around 12 months, but in practice it usually takes 18–24 months or more because of examination backlogs. Rights date back to the filing date, and protection runs 10 years from filing, renewable indefinitely. Because the filing date fixes priority, filing early is always beneficial.
What can delay it
Common causes of delay include mis-classification under the Nice system, office actions requiring a response, and third-party oppositions. A pre-filing search and correct classification reduce these risks.
