Divorce Court Fees and Costs in Vietnam
An overview of how court fees for divorce are structured in Vietnam, including the difference between cases with and without disputed property.
Table of contents
Divorce in Vietnam involves court fees payable to the People's Court, and understanding how those fees are structured helps you budget for the process. The amount depends mainly on whether the case is uncontested, contested, and whether it involves the division of property with a monetary value.
How fees are structured
Court fees generally fall into two situations. Where the case does not involve valuing property, a fixed fee applies. Where spouses ask the court to divide property that has a monetary value, the fee is usually calculated by reference to the value in dispute, so higher-value property leads to a higher fee. Beyond court fees, parties may also incur costs such as document certification and, if they choose, professional representation.
Who pays
- In an uncontested divorce, the spouses typically share the fixed fee as agreed.
- In a contested divorce, the court allocates fees in its decision, often against the party whose position is not upheld.
- Certain applicants may be eligible for fee reduction or exemption under the applicable rules.
Other costs to consider
In addition to court fees, you may need to pay for certified copies of documents, translation where foreign-language documents are used, and valuation where property must be assessed. Planning for these ancillary costs avoids surprises later in the process.
Frequently asked questions
Is there a single fixed fee for every divorce?
No. A fixed fee applies where no property value is in dispute, but fees are value-based where property is divided.
Can fees be reduced or waived?
Some applicants may qualify for reduction or exemption under the relevant regulations, subject to court assessment.
Do I pay extra for a foreign-element case?
Foreign-element cases are heard by the provincial court and may involve additional costs such as translation and legalisation of documents.
